By accessing or using DavosAI, operated by DIGITAL DATA CAPITAL S.R.L. (CUI 50475197), a Romanian company headquartered in Bucharest, Romania, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

2. Service Description

DavosAI is an AI-powered platform for generating personalized videos at scale. The platform provides:

• AI-generated video creation using Google Veo technology
• Batch processing for generating multiple personalized videos
• Prompt template management with variable substitution
• Organization and team management with role-based access
• Credit-based usage system
• Video download and management

3. Account Requirements

To use DavosAI, you must be at least 18 years old. Account creation requires administrator approval. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use of your account.

4. AI-Generated Content

AI-generated videos may contain errors, inaccuracies, or unexpected results. You are solely responsible for reviewing all generated content before use or distribution. You retain ownership of the videos you create using the platform, subject to any applicable third-party terms (including Google's terms for Veo-generated content).

5. Acceptable Use Policy

You agree not to use DavosAI to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Generate deceptive, misleading, or fraudulent content
• Create content that promotes illegal activities, violence, or harassment
• Attempt unauthorized access to the platform or its systems
• Scrape, reverse-engineer, or interfere with the service
• Generate content depicting real individuals without their consent

6. Credits and Payment

Video generation requires credits, which are allocated by organization administrators or platform administrators. Credit usage and allocation are subject to change with 30 days notice. Each video generation consumes credits regardless of the result.

7. Intellectual Property

DIGITAL DATA CAPITAL S.R.L. owns all intellectual property rights in the DavosAI platform, including its design, software, and trademarks. You retain rights to your input data (names, prompt templates) and the generated video content, subject to applicable third-party terms. By using the service, you grant us a limited license to process your data solely for service provision.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR MEET YOUR SPECIFIC REQUIREMENTS. WE DO NOT GUARANTEE THE QUALITY, ACCURACY, OR SUITABILITY OF AI-GENERATED VIDEOS FOR ANY PARTICULAR PURPOSE.

9. Limitation of Liability

To the maximum extent permitted by law, DIGITAL DATA CAPITAL S.R.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of profits, data, or business opportunities.

10. Indemnification

You agree to indemnify and hold harmless DIGITAL DATA CAPITAL S.R.L. from any claims, damages, losses, or expenses arising from your use of the service, your content, or your violation of these terms.

11. Termination

Either party may terminate the relationship at any time. We reserve the right to suspend or terminate your account for violation of these terms. Upon termination, your data will be deleted within 90 days, except where retention is required by law. You remain liable for any fees incurred prior to termination.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms and revising the "Last Updated" date. Your continued use of the service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of Romania. Any disputes shall be resolved by the competent courts of Bucharest, Romania.

14. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
